If you are receiving financial support toward your educational activity we require a signed commercial support agreement. The list below shows the typical items included in a Commercial Support Agreement. Feel free to email cehp@missouri.edu for more specific information.
- Commercial Support
- “Commercial support” is defined as financial or in-kind contributions given by an ineligible company/organization which is used to offset all or part of the costs of a continuing professional development activity. “In-kind support” may be materials, space, meals/food, equipment, teaching tools, marketing services, or other non-monetary resources or services used by Sponsor to conduct the Activity. “Financial support” can be “restricted” or “unrestricted,” but shall not be used to pay travel, lodging, registration fees, honoraria, or personal expenses for non-speaker attendees.
- Financial support may be used for students, residents, or fellows to attend the Activity provided that the selection of recipients is made by the academic or training institution, or by Sponsor with the full concurrence of the academic or training institution.
- The financial support shall be made payable to The Curators of the University of Missouri. Supporter shall pay no other funds (other than registration fees) to The Curators of the University of Missouri, the University of Missouri -Columbia, the Continuing Education for Health Professions, or faculty or others involved with the Activity.
- Purpose and Control of Activity
- The Activity shall be independent and non-promotional, focused on educational content, and free from commercial influence or bias. Information presented about commercial products shall be objective and based on scientific methods generally accepted in the medical community.
- Sponsor shall maintain full control over the planning, content, quality, scientific integrity, implementation, evaluation, and selection of speakers, moderators, authors, and faculty for the Activity.
- Supporter may not jointly provide the Activity.
- Supporter shall not engage in scripting, targeting points for emphasis, or other actions designed to influence the content of the Activity.
- Disclosures
- Meaningful disclosure shall be made to the Activity participants of the following:
- Supporter’s support of the Activity without reference to specific products;
- Any significant relationship between Sponsor, authors, presenters, or moderators and Supporter; and
- Whether any product associated with Supporter mentioned during the Activity is not labeled for the use under discussion or is still investigational.
- The above disclosures shall be made in writing in all instances when that is possible. Should disclosures occur verbally, such disclosures must be documented in the Activity file.
- Meaningful disclosure shall be made to the Activity participants of the following:
- Scope and Presentation of the Activity
- The title of the Activity shall fairly and accurately represent the scope of the presentation.
- The Activity shall present discussion of multiple treatment options, where available, and shall not focus on a single product except where options are so limited as to preclude meaningful discussion.
- Faculty shall be instructed to use generic names of products or, if trade names are used, to use those of several companies, when available.
- Opportunities for meaningful discussions and questions shall be provided during an in-person Activity.
- Sessions presented by Supporter during an in-person Activity will not take place concurrent to accredited sessions, and shall not occur in the same room as the accredited sessions unless there is not a physically-separate location. There must be a minimum of 30 minutes between accredited sessions and Supporter-presented sessions, both before and after Supporter-presented sessions.
- When sessions are presented by Supporter during a virtual Activity, the participants shall be clearly notified that the session is Supporter-presented and 30 minutes of free time will be allotted both before and after the session.
- Conduct of Supporter at Activity
- Placement of an exhibit for Supporter shall not be a condition for support of the Activity.
- No commercial promotional materials shall be displayed or distributed in the Activity space immediately before, during, or immediately after the Activity.
- Representatives of Supporter may not engage in sales activities in the space in which the Activity occurs.
- Information about Supporter’s product(s) presented in the Activity may only be disseminated after the initial presentation by or at the request of Supporter or an independent person, or in response to an unsolicited request from a participant.
- Social Events Paid For By Supporter
- Social events shall not compete with, nor take precedence over, the Activity.
- The appropriateness of a social event is at the sole discretion of Sponsor, and Sponsor shall have the final authority in the scheduling and production of the social event.
- The cost for the social event shall be modest.
- Use of Logos and Slogans
- Logos or slogans of Supporter may not be used in the Activity space, including slides, printed materials, in-room signage, and other presentation tools.
- Logos or slogans of Supporter may not be present on an app for the Activity if that app also contains educational material.
- The name of Supporter may be listed in marketing materials in plain text.
